Tweaking the Entry


As I sit here typing, I am listening to a sound I haven't heard in a long while...
Rain. My backyard here in the city actually has a small lake in it:

As you can tell from the picture, the drought and the puppies have been hard on my poor yard. The grass is gone pretty much right off the patio. It's a trade off though - sweet pups or grass...and I'd rather have the dogs as they bring me such joy. Anyhow, the grass can be replaced when they calm down. :o)


Here at the farm, I am tweaking my entryway.I'm still trying to get it to look "right".It's hard as it's all part of the living room - and that is not all that big. You can see a good picture of it here.Right now it looks bare and I'm having a hard time making it feel warm and welcoming.I know it's a process, but sometimes my frustration level goes up.I do have a plan in my head for when we move and bring the rest of our furniture up but until then I am tweaking and hoping to hit on a good balance.This is what it looks like right now:

Anyway, I pulled all the pictures off the wall, patched the holes in the paneling and touched up the paint. I wanted to use this old window:



So I cleaned it and brushed the peeling paint off then propped it up on the table. Next, I draped a leaf garland around it, then hung my little twig wreath from the window latch. The tabletop also got refreshed. I kept the chickens but added a sunflower spray and just simplified what else was on it.

The chalkboard plate also got a new message: Please Hurry Fall!Yes, please. The heat is wearing me out. I'm looking forward to that first cold front that blows through and drops our temperatures down into the 70's and 80's.(Hopefully tonight!)Hey here in the South, we take what we can get! :o)



I've decided I need a runner in front of the entry table so I'm off to Home Depot to see if they have one that goes with the rug I got for the living room. I'm thinking it will help pull the two spaces together and make the entry table feel like it's not floating in space.So, that's where it's at for now. This little guy wants you to have a happy Fall:



Oops! I guess I need a bow or something to hide the fine looking hook. :o/

Stays revisited IPCom v HTC in the Court of Appeal




Earlier today the Court of Appeal for England and Wales gave an important and keenly-awaited ruling in IPCom GmbH Co Kg v HTC Europe Co Ltd Others [2013] EWCA Civ 1496, a decision on whether and when to stay national validity proceedings pending the outcome of European Patent Office (EPO) invalidity proceedings. This decision, which was not available online when news of it first broke, is now accessible on the excellent (and free) BAILII database here.

Taylor Wessing LLP has prepared an unusually helpful news bulletin on this case, which is also available online with hyperlinks to citations. It says, in relevant part, as follows:"The Court of Appeal has today given judgment in IPCom v HTC – a case concerning the validity of a European patent due to be heard in December 2013. HTC applied for a stay of the English validity proceedings pending the outcome of proceedings concerning the same European patent at the ...EPO. Roth J at first instance refused HTC's application .... The Court of Appeal has upheld his decision. This is the first time that the Court of Appeal has ruled on such a stay application since the Supreme Court suggested in Virgin Atlantic v Zodiac that the guidelines set out by the Court of Appeal in Glaxo v Genentech should be considered again.


In the light of this decision, it is to be expected that the considerable duration of EPO proceedings will continue to point in favour of refusing a stay of English proceedings in most cases [this blogger thinks that the trend towards refusing a stay will accelerate anyway since, as patent litigation in England and Wales becomes faster and more efficient, and case management becomes more cogent, the likely duration of any stay will be longer. Meanwhile, in the fast-moving ICT technologies in particular, the commercial life of litigated patents is likely to continue to grow shorter].


Parallel validity proceedings for European patents


The European patent system allows proceedings concerning validity to run concurrently in both national Courts and the EPO. The reasons for requesting a stay in these circumstances are plain: there is the possibility of wasted costs and/or conflicting decisions. All else being equal, it might be said to be sensible for the national Courts to wait and see what happens at the EPO where a decision to revoke a patent trumps a finding of validity in a national Court.


However, ... proceedings in the EPO typically last many years. A decision from a national Court may arrive much quicker and still provide the parties with a helpful measure of commercial certainty, despite the fact that it only applies in that particular jurisdiction.


A number of English cases have addressed what should be done when proceedings are under way on the parallel national and EPO tracks. English proceedings have often been allowed to continue, despite the risk of wasted costs or inconsistent decisions, because a final decision of the EPO is still many years away. The leading case was Glaxo v Genentech, where the Court of Appeal set out a number of guidelines, including:
"If the likelihood is that proceedings in the Patents Court would achieve [some certainty] significantly sooner rather than the proceedings in the EPO, it would normally be a proper exercise of the discretion to decline to stay the Patents Court proceedings."

Roth J applied the Glaxo guidelines in dismissing HTC's stay application at first instance. However, he allowed permission to appeal because the Supreme Court had indicated at around the same time in Virgin Atlantic that the Glaxo guidelines should be reconsidered [it's a pity that the parties in a subsequent case should be made to pay for the reconsideration of rules that was identified as being necessary in an earlier case -- but someone has to pay the price of judicial law-making]. Virgin Atlantic concerned the impact of a later revocation of a patent on an earlier award of damages for infringement, .... Their Lordships highlighted that failure to stay national proceedings could lead to injustice to a defendant ordered to pay damages for infringement of a patent later revoked by the EPO. Furthermore, national decisions were only national, whereas a decision of the EPO applied in all designated states and the potential for inconsistency, uncertainty and wasted cost through allowing national proceedings to continue was not desirable.

In upholding Roth J's decision to refuse the stay, the Court of Appeal considered each of these criticisms of the Glaxo guidelines. While recognising that the guidelines required some revision, the Court did not consider that they should be swept away altogether. In recasting the guidelines, the Court paid particular heed to the issue of potential injustice to a defendant ordered to pay damages by a national court, but proposed ways of mitigating this injustice (e.g. by requiring the patentee to undertake to repay the damages if the patent were subsequently revoked). ... [I]nconsistency and wasted cost could only be avoided altogether (or rather potentially avoided) if stays were mandatory, which was not what the Supreme Court had suggested. Rather, these factors were inherent consequences of the European patent system, which the Courts have to take account of and manage as best they can".

How did Jesus fulfill these things? There were still poor, oppressed people there at the time and there would be after he left. He was doing more than they expected. What he was doing was more important than getting rid of the Romans or restoring material blessing. Whats the point of getting rid of the Romans if youre still enslaved to sin? Why explain the finer points of the law when our hearts want to reject the giver of the law? Jesus bypasses what they were expecting because he wants to go deeper. He doesnt want to clean up a spot, he wants to grab a scalpel and cut out the root.

The problem is worse than physical poverty, its spiritual poverty - we are not pure and holy and Jesus has come to proclaim the good news that that can change - by Jesus taking our sin and giving us his righteousness (2cor5:21)

The problem is worse than being in prison or exile or occupation, its slavery to sin - we cant walk away from it, we keep going back to it. Jesus has come to proclaim freedom from that - breaking the bondage of sin (Gal 5:1 It is for freedom that Christ has set us free. Stand firm, then, and do not let yourselves be burdened again by a yoke of slavery)

The problem is worse than physical blindness, its spiritual blindness - we are blind to the reality of who God is and keep messing around with man-made religion like the blind leading the blind. Jesus healed blindness as a practical demonstration of the fact that he is the light of the world, revealing our true nature as rebels and Gods true nature as a loving Father.

The problem is worse than rich people oppressing poor or powerful oppressing weak, its the condition of the human heart that makes us want to oppress and exploit, that makes us love ourselves and use others. Jesus has come to set us free from that by giving us everything when we deserve nothing.

Jesus has come to proclaim the year of the Lords favour, which is more than the year of jubilee when slaves were freed and land returned. Its a spiritual Jubliee, its God lavishing grace on us freely. Its about Jesus making a way for an unholy people to be welcomed back into the presence of a holy God.

The next book I've selected for the 2014 Most Anticipated Event is actually two books for the price of one. This author has TWO amazing sounding novels coming out in 2014 and I couldn't pick just one. Katherine Longshore's Brazen and Manor of Secrets.

1. Describe Manor of Secrets in three words.

The tagline on the front cover pretty much sums it up:

Upstairs. Downstairs. Drama.

2. Can you give us a little tease about the third Royal Circle book (which we now know is called Brazen)?

BRAZEN takes place in the time period between TARNISH and GILT and follows the story of Mary Howard (daughter of the Duke of Norfolk, who we also see in GILT). There are weddings and funerals, secrets, betrayals, friendship, ruination, love and hope. It was also the most difficult book I've ever written, possibly because I was being more brave with my writing and the emotion often struck close to home. My editor says its my best work yet.

3. Both novels are historical, but sound quite different. How did the research differ for each book?

Because I have already done so much reading and research on the Tudor era, my research for BRAZEN was very specific to time, place and character. Unfortunately, theres not much written about Mary, so I had to do quite a lot of digging! Many, many hours in front of the computer trolling through the Letters and Papers of Henry VIII.

Researching MANOR OF SECRETS was completely different. I wasn'tt writing about real people, so I didnt have to research hair color or personality quirks or who was where, when. But I did have to catch up on my history. Before I started writing, all of my early 20th century knowledge came from E.M. Forster novels, my costume design classes, and Downton Abbey. I had an absolutely wonderful time reading about how a Manor house was run, what daily life would have been like (dressing for dinner every night?) and what events shaped the summer of 1911. My favorite part of that research was reading the biographies of women in service—kitchen maids and cooks, especially. Even now that MANOR is finished, I read these books for fun!

4. How would the main character in Manor of Secrets describe the main character in the third Tudor book and vice versa?

Charlotte (the dukes daughter in MANOR) would probably think that Marys life is romantic and adventurous—the royalty, the opulence of the court, falling in love. Janie (the kitchen maid) would possibly think Mary was spoiled—she never had to work a day in her life. But Janie would also see the difficulty and tragedy beneath the romantic veneer of the Tudor world.

Mary would recognize a kindred spirit in Charlotte—leading a life that on the surface is perfect, but in reality is full of demands and disappointment. And Mary might almost be jealous of Janie—a girl who can earn her own wage and therefore has control of her own life.

But when they really got to know each other, I have a feeling that all three girls would be friends.

5 What 2014 release are you most looking forward to?

Im looking forward to so many! INTO THE STILL BLUE by Veronica Rossi, A MAD, WICKED FOLLY by Sharon Biggs Waller, MAID OF DECEPTION by Jennifer McGowan, ISLA AND THE HAPPILY EVER AFTER by Stephanie Perkins, THE SOUND OF LETTING GO by Stasia Ward Kehoe, WHAT I THOUGHT WAS TRUE by Huntley Fitzpatrick…I could go on—so many wonderful books coming out next year!
